FAKE NEWS: AMU OPENS CENTRE OF CORRUPTION STUDIES

Aligarh, October 25: The visionary Vice-Chancellor of Aligarh Muslim University Prof. P .K. Abdul Azis today in a Press Conference announced that a new chapter is going to be written soon in the pages of our Alma Mater as from the academic session 2010-11 a Centre for Corruption Studies is going to be operational in our University. The recent revelation in the National Media that the Two Judge Inquiry Committee constituted by President of India to Inquire into the financial bungling at AMU worth 90 lack has already spent 43 lack allegedly without following rules has generated huge interest among the Indian Citizens and many believe only AMU can provide world class education with state-of-the-art infrastructure in Corruption Studies.

It has been decided that three courses namely “Diploma in University Corruption”, “Diploma in Judicial Corruption” & “Diploma in Games Corruption” will be started at first as on experimental basis and then later on University may offer Graduate Degrees in the coming years. The Vice-Chancellor said in his statement that it’s a matter of pride that Chairman of Olympic Committee Shri Suresh Kalmadi has agreed to be the Guest Lecturer for the students enrolled in “Diploma in Games Corruption” & Former Chief Justice of Karnataka tainted Justice P.D.Dinakaran would deliver some initial lectures on process to commit Judicial Corruption. However at the request of many prospective students and prominent Old Boys Vice-Chancellor has kindly agreed to take the classes in “Diploma in University Corruption” out of his busy schedule.

It has been decided that the Centre for Corruption Studies shall be directly attached to the Vice-Chancellor’s Secretariat in spite of repeated requests from the Deans from the Faculty of Arts, Faculty of Social Sciences, Faculty of Commerce, Faculty of Management Studies and Faculty of Law. Vice-Chancellor passionately argued that though Corruption is an art and philosophy both, or results from flawed economic theory, or it’s related to trade and business, or about imperfect management, or a completely legal issue but as his Officer has beautifully blended it all as alleged his Secretariat should get this honour. To overcome the legal hassle in attaching an academic body with administrative body like Vice-Chancellor’s Secretariat it has been made clear that necessary changes will be made in Section 5,6,11 and Statute 20 the Aligarh Muslim University Act. He hoped that to pave a new era in his struggle to retain corruption in India the members of Executive Council, Academic Council and AMU Court will unanimously pass such changes keeping full faith in the Vice-Chancellor’s noble initiative.

In answering one question the Vice-Chancellor rejected the apprehension that some disgruntled Old Boys can thwart this opening of new Centre by taking the legal route. He made it clear that such outside elements only want to disturb the peace and tranquillity required to run such modern Centre of Corruption and Indian Courts would surely dismiss such case on the grounds that these Old Boys do not have local standi in the corruption going on at AMU.

He said he has already received proposals from various state Governments to start such new Centres in their backward districts and already offered the help of hundreds of senior Officers already excelling on this subject. People from all these places has shown tremendous response to such noble idea where they believe that the vision and mission of corruption from this iconic Vice-Chancellor should reach at their door and by 2020 they become full fledged University with the help of the UPA Government recently internationally famous for CWG corruption.

P.K.Azis regime holds record in Student Oppression

I said recently that Public Relations Office has always acted like the propaganda machine and during the war mongering seasons against students its the Berlin Radio of Hitlers Germany. Even today the food boycott by the students from VM Hall and Habib Hall in support of the students sitting on hunger strike has got a different colour in the Press Release of the meeting of VC with Provosts. Amar Ujala the local Hindi paper has reported the incident of SS Hall as " SS Hall walo ne Khana Chhora"..Well so its evident that media is not buying PRO's story and reporting the facts with very much objectivity..

Now one of my colleague from the Dept. of Mass Communication ( MA in 2009)  Mr.Shehzad Alam has filed an excellent RTI application at the Proctor Office. I have till now proved with documentary evidence that Proctor Officials at AMU usually relish in harassing students at petty issues and played with the career of many by sheer manipulation which I equate for a student with death. They neither have any morality nor any respect for the rule of law which is evident from their False Departmental Inquiry reports obtained in RTI. To silent students, to harass them, to frighten them or to scare them away at its best they are the expert by calling them for trivial interrogations. Once during the conduction of a Departmental Inquiry while Asst. Proctor Dr. Hasan Imam issued a Call slip asked me questions, A IInd Year Law Student came to the Proctor Office and he was so scared just that Proctor Office issued Call Slip to him that he was in tears and begging literally that he knows nothing and plead that they should not suspend him. While I was firm to face any Officer but this guy’s teary eyes and the subsequent smirk on the Proctor Officials that they can torture any student made me feel so pathetic of that place called Proctor Office. Things were not like this before 2007. And such terrifying interrogations are the reality of Aligarh Muslim University only. You want to know how many has happened till now ?

Mr. Shehzad filed an RTI with the questions
1.       Since 1 July, 2007 how many students have been called by the Proctor Office with call slip? Kindly provide the certified list of those students along with the name of student, class, Enrollment No., date of Call, Timing of Call, designation of the authority who called the student, reason of call and the result of Call.
2.       If the timing of the Call clashed with the timing of the classes, then whether the Proctor Office issued the class attendance relaxation letter to the students or to the concerned Chairman. If yes, then how many students have been issued this kind of letter? Kindly provide the list of that student/Chairman , along with name, despatch number of letters and date.

And the reply is shocking. According to the reply furnished by the CPIO, Proctor Office letter vide D.No. 168/Proc dated 9.9.2010 the RTI applicant were asked to submit Rs.4802 to get the copies of 2401 Call Slips issued.

The simple answer is- Since July 1, 2007 the Proctor Officials at the AMU has summoned 2401 students for interrogation. The shocking average is 3 students per day since that time.
In what kind of dystopia we are living that everyday 3 students are paraded to the Proctor Office for this and that. As I have said this is just a systematic scaring tactic of the students which is in practice now. And such summoning of students in thousand is unseen at any University in India in the name of maintaining discipline.( Look at the papershttp://www.box.net/shared/2yobbq3586)

In another RTI application that I filed at the CPIO, Dept of Higher Education, Govt. Of India regarding the disciplinary actions on students at the various Central Universities since July 1, 2007 the answers that are coming from the CPIOs of various Central Universities should hang the head of AMU authorities in shame.
The number of students suspended while 152 at AMU now in the last 3 years, this number has not touched even 8 in any other University in India for the same time. So AMU is in the way has taken disciplinary actions on students unimaginable times higher. Well even we justify the rustication of 40-50 students in the 2007 VC lodge arsoning case , what other things happened that such a large number of student get suspended is only a mystery.

Vice-Chancellor Janab Prof.Azis Sahab did a lot of favour to me by his actions( the media ones and the respect I got in universities like JU) . So hence I am on the way of returning his favour. Through my contact I am in touch with Limca Book of Records people and they are interested with this data collected as such first time in India regarding the disciplinary actions on students so heavily. So probably our current Vice-Chancellor’s name soon be added on the basis of those documents in the Limca Book of Records for Highest Number of Suspension by Vice-Chancellor in India. May be after some years while playing with the grandchildren he can’t boast of his other achievement at AMU, but his name embossed on the pages of Limca Book of Records would definitely be something to be proud of. I am trying with the contacts if Guinness Book of Records people would be interested or not in such data.

Lyndoh Committee recommendations which is accepted by the Govt. of India now has mentioned the necessity of the Students Union on account of illegal and systematic suppression of students through massive disciplinary actions in the name of maintaining Discipline.
In the heading NEED FOR STUDENT ELECTIONS AND STUDENT BODIES/ORGANIZATIONS in 6.1,

Lyndoh Committee noted,
“On the other hand, various instances were brought to the notice of the Committee
involving harassment of students by the faculty and the administration, including sexual
harassment, charging of exorbitant capitation fees for obtaining seats in courses as well as, ostensibly, for the provision of ‘infrastructural facilities’ to the students, as well as the imposition of unusually harsh norms on day-to-day student life in the name of maintaining discipline in the institution.”

Aligarh Muslim University with all the RTI replies which documented the systematic harassment of the students and finishing off the careers of many students for no reason unlike in any other University in the whole country has only justified the Students demand for the immediate restoration of AMU Students Union.
I sometime really miss to be the part of this student movement. In my case where the entire institution was used and put against a student abusing all the laws of the land we needed a strong reaction of institutionalizing such crime. Students still come to me and say we still consider you one of amongst us and I just can’t but advise them on legal and media affairs. But students need a revolution to oppose such student’s oppression here.

Moosa Raza Committee and AMUSU

My simple question to the Vice-Chancellor, have you simply thought before putting this statement that the students of the institution that you are running are fools or muggins or saphead or buffoon or flibbertigibbet or meshuggeneh or even monosoph? I mean words are felling short to describe the way you want to mislead the student community with such misleading statement. I have now visited many Universities in India and can firmly say that students at Aligarh Muslim University are quite intelligent and can debate on serious topics if proper guidance is provided.

No I am not unhappy that AMU Court has appointed a Committee led by Janab Moosa Raza Sb to review the Act and Statutes. But what the hell it has to do it with only the single statute of 34 of the AMU Act, 1981 dealing with AMUSU and when the Vice-Chancellor himself said “Act and Statutes” and I think the plural form emphasize its for the entire AMU Act and Statutes. Let us analyse the AMU Act, 1981 and the Statutes in it.

 

There are 41 sections and 61 Statutes in the Aligarh Muslim University ( Amendment) Act, 1981 which was passed by Parliament of India.

Statute 34 says, â€œ*34. Students’ Union - There shall be a Students’ Union to be known as Aligarh Muslim University Students’ Union. The Vice-Chancellor of the University shall be the Patron of the Union.”
There is one Section in the AMU Act whose use has been often questioned. Section 19(3) of the same Act is known to us all for its notoriety in its use by many Vice-Chancellor including the present one. It reads as, â€œThe Vice-Chancellor may, if he is of opinion that immediate action is necessary on any matter, exercise any power conferred on any authority of the University by or under this Act and shall report to such authority the action taken by him on such matter;.... thereupon the Executive Council may confirm, modify or reverse the action taken by the Vice-Chancellor.”

Recently some teachers got elected in the Academic Council of the University under various categories. This name of those teachers was published by the Public Relation Officer also in a recent Press Release. This was done by the AMU authorities to follow the Statute 18(1)(x) of the same Act where it says, â€ 18. Academic Council- (1) The Academic Council shall consist the following members, namely: - **(x) Three Professors; five Readers; and seven Lecturers.”

However the same Statute 18 under the clause (xiv) & (xv) provides mandatory representation of the 5 students in the same Academic Council. But alas! There is no one.
So definitely there are some simple question comes up which only question the logic of the statement given by the Vice-Chancellor without any rationale,

1.     Why only Statute 34 to be suspended till the report of the Moosa Raza Committee arrives in the next 3 months and not the other 41 Sections and 60 Statute of the same Aligarh Muslim University( Amendment) Act, 1981? Why only Statute related to the democratic right of students has been particularly selected to be targeted by the future report of the Moosa Raza Committee?
2.     Whether Vice-Chancellor can assure that till the report of the Moosa Raza Committee to review the Act & Statute of the AMU he shall not use Section 19(3) suspending his own emergency powers as he is doing with the students by suspending their democratic rights taking vague shelter of the future Committee report?
3.     Why without the arrival of the Moosa Raza Committee on the Acts and Statutes of the Committee AMU authorities hold elections for the representation of the AMU teaching community in the Academic Council as per the Statute 18(1)(x)? Why this election was not hold till the Committee report arrived? Why the university is shamelessly discriminating with the students?

My simple advice to the agitating students, start a movement and this should be visual as much as possible. The theme of the movement should be
WHY ONLY STATUTE 34, WHY NOT SECTION 19(3)? WHY NOT ALL THE ACT AND STATUTES?
Vice-Chancellor sir, again I would like to advise you with utmost respect to believe in the intellectual and academic credibility of your students to read and judge. Don’t underestimate them so much. If the parent of the institute would fool them whom they would look up to?

Student's Dharna, Legal Blackmailing and AMUSU Constitution



The month of revolution is back. So are the heinous practices of the AMU administration. We have seen things in past and I proved them with documentary evidence. After students started their peaceful agitation this time for the legitimate demands of the students the first thing AMU administration did is to activate its propaganda machine through the Public Relation Office in the Stalinist way. The phrases like “Outsider” started coming in without any documentary evidence. I have posted the Secret Paper in past where Vice-Chancellor tried to link an AMU incident with Al-Qaeda. Even this time again they mentioned â€œOutsider”. My simple question, Sir, is it Al-Qaeda again? Ohh you have got the chance again to pass another Crores of Rupees for Security in the dark rooms of North Block! Grab it at any cost Sir. Home Ministry will bless you.
 They must have also activated the LIU group and senior Proctorial Officers must be writing draft after drafts of the Departmental Enquiry Report of this whole incidence (based on nothing of Course) to prove their mettle in creative writing. After all whosoever write the Best Fiction in the first opportunity like this can ask for any favour ( Read lucrative post, Selection Committee favours you know). My best of luck to the ones who will write this Departmental Enquiry Report in the coming days. I will write a literary review of course without any favour though whenever I get it through RTI.

A Grievance Meeting is being held, a meeting was called immediately and a Press Release came in that Toppers assured the Vice-Chancellor that they are not the part of the protest. So the propaganda is- only bad elements are the part of it. We know a famous way to declare peace, put a gun on anyone’s forehead and forcing him to say, ‘yes its Peace’. But till I am with the AMU students, I will never let their propaganda machine work. The gun tottering tactic started the day AMU students organized a huge peaceful rally to demand the removal of the despotic characters and restoration of Students Union. But when students are pushed to the wall, I know the fallen shall rise again.
Now AMU authorities have started legal blackmailing of the students community. The days of Committees are over. It’s just eyewash. Last year it was promised to the students that Committee on the Students Union would submit its report in 3 months but only to fool students.
 Well I have some legal advice to my fellow brethren at the Dharna site which I want to convey through this forum.
The demand for the Students Union should be a non-negotiable demand and there should be no discussion on it and this is supported by the AMU Act, 1981. The recent Press Release that is coming up is just to mislead the students community.  Every Act is in force till it is amended or repealed. Even till the last day. Now the Statute 34 of the AMU Act, 1981 clearly states that, *34. Students’ Union - There shall be a Students’ Union to be known as Aligarh Muslim University Students’ Union. The Vice- Chancellor of the University shall be the Patron of the Union.
Now this Act was passed by Parliament and therefore the “shall” word emphasize that its mandatory for the AMU to have a Students Union. So even if the AMU authorities are blabbering about some AMU Courts decision to review the Acts or Statutes, its effect is only in perspectives terms and not in retrospective way. So at this moment the legal stand is very clear. That no committee, no body is empowered to stall the restoration of the Students Union untill that Statute is amended or repealed. So buddies, don’t listen to these craps. Don’t attend any meeting or consult with any Committee till official notice comes about the restoration of the AMU Students Union by October. AMU administration will only fool with such tactics. And ultimately their aim is that instead of restoring Students Union following Statute 34, they will say as talks failed and student are not relenting in their protest, so lets declare sine die. Students must realise that Students Union is their statutory right and the demand must be met at any cost.
If someone comes and says that problem in the restoration of Students Union is arising due to the Lyngdoh Committee report, the legal logic is plain and simple. Lyngdoh Committee report is already challenged at the Constitutional Bench of Supreme Court and its recommendation is from Judiciary, whereas the AMU Students Union is mentioned as mandatory by the Parliament of India which is the Supreme Body in India. So Parliament should be followed.
The argument that due to violence we are not restoring Students Union also lack rationality, which if is applied at the National level ( considering the  large scale violence happen in some parts) will only cease the Parliamentary Democracy of India and bring the black days of Emergency.
And remember my friends, in the end what matters is “WE THE PEOPLE”...Long time back AMUSU Constitution was written and it shall be our guidance even now because it was declared by the “We the Students of Aligarh Muslim University’. AMU administration even today charge Rs. 60 for AMU Students Union.
So according to the Clause 1, Chapter II of AMUSU Constitution, AMU students are still the member of the AMUSU. It means you just have to restore it.

And my dear fellow students, don’t feel disheartened when AMU authorities claim that those who are protesting are criminal elements. You know, recently one senior Proctorial Officer took law onto his hands and browbeaten a poor Risksha Puller because he was fetching the tent for the agitating students. What a proud display of muscle power on a poor fellow who earn by toiling all the day. Is not it a criminal Act? Who doesn’t know that 4 top Officials were booked under various sections of IPC ( criminal trespass and all) in the Dr. Siras Case! Or long time back a Hindi daily flashed the report of an FIR against Registrar and all. Or the recent FIR against the Vice-Chancellor himself by one Polytechnic student on account of Forgery! Or have we forgotten that the top AMU officials are still under Presidential Enquiry for financial bungling which is a criminal act? So my dear students, no one can allege that you are a criminal unless there is any FIR or even allegations. Those who are doing it have just lost all the sanity by being involved in their alleged criminal actions.

And now, when students are agitating for the restoration of AMU Students Union, I wish to gift them the digitize copy of the Constitution of AMU Students Union. I procured it through the RTI and digitized it for wide circulation. Student Grievance Redressal Committee can be compared with AMUSU because of this Constitution. My dear fellow students, in your struggle, read it everyone arm yourself with this legal document which was not available anywhere till date except the dusty racks of Council Section, Registrar Office, AMU. The AMU Website displays every Act and Statutes for the RTI movements, even the Students Conduct Rules, 1985 but not AMUSU Constitution( AMU authorities hate democratic student representation or doesn’t understand the concept of Democracy). I hope it will also rekindle the nostalgia among the Old Boys also who may download it from here,
